Its Monday Morning At Emc World 2011 And Emc Chairman

It's Monday morning at EMC World 2011 and EMC Chairman Joe Tucci opens the show with 10,000-plus in the audience. On stage with Tucci are big black boxes. What's wrong with this picture? EMC is no longer a company that can be primarily characterized as a maker of big black boxes. Tucci has engineered a transformation of EMC from an enterprise IT storage box vendor to a provider of computing platforms. Let me count them: Nos. 1, 2, and 3: Foremost among EMC's platforms is VMware. EMC owns approximately 85 percent of it, but unlike his predecessors in old days of EMC the box company, Tucci has protected the independence of VMware. And it's clear in the response from customers that the independence is greatly appreciated. VMware now dominates the virtual OS landscape. To this, VMware recently added the Cloud Foundry and the VCUBE application "container." Both qualify as platforms in my view. Nos. 4 and 5: But VMware is not the only EMC platform. The Greenplum database is a platform for big data analytics and now represents the foundation of an EMC data computing division. To that EMC announced, here at this event, the addition of an EMC/Greenplum-branded appliance that runs a commercialized version of the Apache Hadoop data analytics platform. No. 6: EMC along with Cisco and a growing number of partners are the marketers of a pre-integrated hardware/software computing platform that integrates Cisco servers and networking gear with VMware and EMC storage: the Vblock. Phase I of Vblock was the instantiation of VCE and the introduction of Vblock to the enterprise IT buying community. Phase II was revealed at EMC World. Efforts are under way to stand Vblock up as a new application development environment. Here, some analogies can be drawn with the venerable mainframe. One source of energy that helped propel the mainframe to dominance decades ago was a vibrant and independent developer community (now known as a partner ecosystem). That aspect of mainframe history is understood by VCE executives. Moreover, some VCE customers are now engaged in projects aimed at re-hosting mainframe applications on Vblock--a non-trivial exercise for sure. No. 7: EMC has transformed its Documentum acquisition into Documentum xCP, a platform that converges structured data and unstructured content. EMC has also integrated xCP with the Greenplum database so that Documentum's content repository can be used as a data source for Greenplum analytics processes. And here at EMC World, EMC announced the availability of VCUBE-encapsulated, "OnDemand" versions of the Documentum repository, Captiva, CenterStage, and Document Sciences. So, are we ready to add EMC to a list of comprehensive systems and platform vendors that now includes Dell, HP, IBM, and Oracle/Sun? I am. Tucci has brought about a transformation that is nothing short of amazing.


Adobe Systems Will Beef Up Its Digital Video Software Through

Adobe Systems will beef up its digital video software through the acquisition of technology and employees from Iridas, the company announced Thursday. The company's video software--Premiere Pro and After Effects--are geared for higher-end users, and the company is investing heavily in them at the same time that videography is democratizing. The arrival of video SLRs, most notably Canon's 5D Mark II, has brought relatively affordable gear into the hands of a much larger audience. The Iridas Speedgrade software offers the ability to refine video in a number of ways, notably what's called color grading, which can shift a video's color tones to give a particular look. Think of the greenish cast of the Matrix movies, for example. Color grading is popular as a way to impart mood and emotion to video. In its news release, Adobe also said the acquisition will help with perhaps the most obvious trend in video these days, 3D. "With the addition of Iridas, Production Premium [a suite including Premiere Pro and After Effects] is expected to gain a comprehensive set of tools so video editors can manipulate color and light for any type of content, including professional film and television," said Jim Guerard, Adobe's general manager for professional video, in a blog post. "Enhanced color-grading is a top requested feature by our Production Premium customers." The Iridas asset acquisition also will help Adobe with HDR (high dynamic range) and raw video, Adobe's Todd Kopriva said in a blog post. HDR photography and videography is a hot and fast-developing technique that attempts to capture details in both shadows and highlights, something that's technically tough. Raw video uses the unprocessed data from a camera's image sensor, which can offer more better dynamic range and color than what's been processed in the camera. Raw imagery requires more after-the-fact processing, though. Terms of the deal were not disclosed, and Kopriva wouldn't comment on specific details of how the technology will be incorporated. As cameras have moved from film to digital and computers have become more powerful, digital video has become accessible to many more people. Apple, with its Final Cut software, fueled the trend and capitalized on it. Adobe once scrapped its Premiere Pro software for Macs, but it reversed course and now is been fighting hard to do better against Final Cut Pro. Adobe is claiming big success. "Demand for Adobe's Production Premium CS5.5 video content creation tools has exploded, growing 22 percent year-over-year," the company said in a statement. In addition, the software has seen "45 percent growth on the Mac, fueled by the large number of Apple Final Cut Pro customers switching to Adobe Premiere Pro."


Armchair Satellite Trackers Hoping To Catch A Glimpse Of Nasas

Armchair satellite trackers hoping to catch a glimpse of NASA's doomed Upper Atmosphere Research Satellite when it plunges back to Earth on Friday will need patience, access to the Internet, a clear sky, and a large helping of luck, experts say. Even with last-minute updates from NASA and U.S. Strategic Command pinpointing when and where UARS will begin its final plunge, the sheer size of the planet, with its vast stretches of ocean and remote terrain, means the odds of catching a glimpse of the spacecraft's fiery demise--or of being anywhere near any falling debris--will be remote. But as re-entry footage of the old Russian Mir space station and the more recent flaming fall of a European cargo craft show, satellite "decays" offer the public and experienced amateurs alike a chance to witness a fairly spectacular show. The UARS re-entry "is nothing to be particularly worried about, and if you're very lucky and in the right place at the right time, you may see quite a nice little fireworks show from it. But it's highly improbable that you'll get even that much out of it," said Ted Molczan, a well-known satellite watcher whose computer analysis and predictions have helped sophisticated hobbyists around the world track down spy satellites and other challenging targets. "You have to maintain reasonable expectations. And in this case, the right expectation is, 'I'm not going to see this.' On the other hand, if you stop there it becomes a self-fulfilling prophecy. So you do want to see it, you know you won't, but (if you make the effort) you might!" The 6.3-ton UARS, launched from the shuttle Discovery in 1991 and decommissioned in 2005, is expected to fall back into the dense lower atmosphere sometime Friday. The bus-size spacecraft will tumble, break apart, and mostly burn up on the way down. But a NASA analysis using software designed to evaluate satellite decays indicates 26 chunks of debris, the largest weighing 330 pounds or so, likely will survive atmospheric friction to hit the ground somewhere along a 500-mile track downrange of the entry point. For comparison, some 42.5 tons of wreckage from the shuttle Columbia hit the ground in a footprint stretching from central Texas to Louisiana when the orbiter broke apart during re-entry in 2003. No injuries or significant property damage were reported. USSTRATCOM tracks some 22,000 objects in low-Earth orbit, ranging in size from about four inches across to the 900,000-pound International Space Station, roughly the size of a football field. But USSTRATCOM's radar network will not be able to pinpoint exactly where UARS will begin its destructive plunge--and thus where its debris might fall and where it might be visible--until just a few orbits before re-entry. "As of Sept. 21, 2011, the orbit of UARS was 120 mi by 130 mi (195 km by 210 km)," NASA said in a brief update Wednesday. "Re-entry is expected Sept. 23, United States time. The time reference does not mean that the satellite is expected to re-enter over the United States. It is simply a time reference. Although it is still too early to predict the time and location of re-entry, predictions of the time period are becoming more refined." Amateur satellite trackers hoping to catch a glimpse of UARS can find predictions for when the satellite will pass above their local horizon at Heavens Above, an authoritative source of tracking information for hundreds of satellites. Veteran sky watchers typically look for satellites within a few hours of sunrise and sunset, when the observer is in Earth's shadow and satellites above one's horizon are still in sunlight. Heavens Above provides rise and set times for an observer's location, along with a sky chart showing the spacecraft's path across the sky. Depending on their size, satellites can appear as very dim, rapidly moving "stars" or, in the case of the International Space Station, rival Jupiter and Venus in brightness. Normally, only sun-lighted dawn and dusk passes are listed by Heavens Above. But for the UARS re-entry, the Web site is listing all possible passes, even those that occur when the satellite is in darkness or broad daylight. If no passes are listed, the satellite never climbs above the viewer's horizon. Molczan advised would-be UARS observers to monitor NASA's latest re-entry predictions as they become more refined and then to compare those times with the list of passes provided by Heavens Above. If the two are close, the observer might have a chance to see UARS' final moments, although one would still need a fair amount of luck. Observers also can monitor Space Track (registration required) to obtain the raw data from USSTRATCOM. Space Track routinely provides decay predictions, including time, longitude, and latitude, for satellites expected to re-enter in the near future. The orbit-defining two-line elements, or "elsets," provided by Space Track can be plugged into satellite tracking software to generate up-to-date maps with a satellite's location shown in real time. "The orbit's going to be changing pretty rapidly," Molczan said of the UARS trajectory. "One of the things that is maybe not always intuitive, the visible part of the decay, the dramatic part of it, is below 100 kilometers. That's really low, and that means you've got to be very close to the ground track to have it some reasonable elevation above your horizon. "Most of us live in urban areas and when you're standing outside, a lot of your horizon is cut off by buildings, trees, that stuff. You've got to take into account that things below 15 or 20 degrees elevation, you're not going to see unless you take special effort to get into a place that's free of obstructions." And once the UARS re-entry begins, the actual path of the satellite likely will deviate from the predicted trajectory. "Of course, on the other hand, as long as it's anywhere above the horizon the decay when it happens is so prominent, how can you miss it?" Molczan said. But even with decades of experience, Molczan has only witnessed one satellite decay--the re-entry of a Russian communications satellite in 2004. "I live in a high-rise building and I went up to the roof, so I had a pretty good view," he recalled. "I knew exactly where to expect it. It came into view, it passed very close to Jupiter, which happened to be sitting there, it was about as bright as Jupiter already. And the point is, it was in the Earth's shadow so the only way I would be seeing it is if it were burning up. "And it had a nice, long plasma trail behind it just like you see with re-entering shuttles. From 10 degrees (elevation) in the southwest, culminating at around 35 degrees and then reaching 10 degrees in the southeast, that took about 89 seconds. It was motoring along. The Ganglians

A quick twirl of Sacramento revealed a surprising number of Bands youve heard of including Papa Roach, The Cramps, Clare Voyant and the wonderful Deftones. The Ganglians dont sound anything like any of them and this is a good thing. They sound like pure, distilled and freshly squeezed essence of California. Wonderful harmonies allied to rich melodies and pure pop. Uplifting and invigorating at once. There is actually a fair bit of complexity in the layers of the music and they play with harmonies in a way that is faintly reminiscent of the Beach Boys but they use pace and tempo to vary the mood like no other band around at the moment and Thats What I Want, arranged around a metronomic drum beat is completely different in method and intensity as, say, Drop The Act or Evil Weave yet all three sound very definitely Ganglians. Having released two albums almost simultaneously in 2009 this can be considered the bands difficult second album but they have managed a real tour de force great listening and huge fun.

New York It Was Like A Black Hole Matthew Rosenberg 28

NEW YORK--"It was like a black hole," Matthew Rosenberg, 28, says of the failure of his first company, eDopter. "It was the hardest thing I've ever done. Having a start-up and putting two years of your life into something and watching it fail is gut-wrenching." eDopter, a trend-tracking start-up, launched in 2008 at a time of peak economic panic, when venture capital activity in New York was stagnant and, as Rosenberg and his co-founder Andy Thompson relate willingly, a prospective investor bailed in the middle of a lunch meeting because he saw what a precarious drop in the Dow had just done to his portfolio. eDopter ran out of money. Rosenberg and Thompson are hoping that the outlook will be brighter for Fast Society, a mobile start-up that they have co-founded with a third friend, Michael Constantiner. And in the short term, that means there is one huge goal on the horizon: make a splash at the South by Southwest Interactive Festival (SXSWi) next month. Powered by a small amount of angel investor money and a whole lot of caffeine, Fast Society has been readying a revamped version of its iPhone and Android apps to launch in conjunction with SXSWi, and almost as importantly, it plans to throw a party to get the word out and accelerate its momentum. The stakes are high: As a gathering point for thousands of technology enthusiasts from around the country who are just as eager to meet up for margaritas as they are to attend conference panels, the annual Austin, Texas, extravaganza has proven the perfect stage for new trends in social media to emerge. Fast Society wants to get noticed, but so do its competitors in the emerging sector of group messaging, in which temporary or permanent clusters of cell phone users communicate with one another through text messaging or a smartphone app. It's a packed space right now. There's GroupMe, fueled by a fresh $10.6 million infusion of capital from top-notch firms like Khosla Ventures and First Round Capital (and which recently announced that it processes 1 million messages per day), and Beluga, founded by a team of former Google engineers. Fast Society acknowledges it's the underdog, and that a poor showing at SXSWi may put it out of the running. "We're scared out of our faces, because there's tons of anxiety and there's so much pressure," says Rosenberg on a weekday afternoon in a conference room at Dogpatch Labs, a group workspace for small start-ups run by tech investor Polaris Ventures. "South by Southwest is already, it's intense, there's a lot going on. And then to launch a new product and to know that people in our space are going to be launching these products at the same time, and to know that everything depends on this...We're competing with people in our space not just in our space but in general that have tons of money." Trifecta Rosenberg is trim, with a prominent brow ridge and round blue eyes that grow wider and wider as he talks in an earnest staccato about Fast Society. Across from him in the Dogpatch Labs conference room are Thompson and Constantiner, both 27, who are quieter than their co-founder but sport the same symptoms of restlessness and sleeplessness--a generous peppering of stubble, dark circles underneath their eyes. All three can finish the majority of each others' sentences; their rapports are as deeply personal as they are professional. Rosenberg and Constantiner have known each other since elementary school in Houston; Thompson was in the same fraternity as Rosenberg at American University in Washington, D.C. At Fast Society, none of the three (they recently hired a fourth employee) holds the title of CEO. Constantiner runs business operations. Thompson is the developer and designer. Rosenberg, who holds the title of "Director of Ideas," says he's the liaison between the two. "What's the word you call me?" Thompson asks Rosenberg. "I feel like he's a unicorn--" Thompson interjects. "They'll just refer to me as 'unicorn' on Twitter." "Andy's probably the best designer I've ever met," Rosenberg says. "And he's probably one of the best designers in the world--" "...and every time he says that, I say, 'Don't say that to people ever again!' It puts kind of a high mark of expectation on me," Thompson jokes. "But it's true," Rosenberg insists, his eyes growing wide. "And he's equally good at development, which is rare." Like a unicorn. Hence the nickname. The ebullient, party-ready Fast Society co-founders are hardly conventional in today's start-up world of change-the-world rhetoric, talk of "platforms" and "utilities," and hardcore allegiance to the "hacker" spirit. Thompson says he has been designing and teaching himself code for most of his life, but beyond that, all three co-founders are marketers rather than engineers, going all the way back to Rosenberg and Thompson's respective college internships at then-upstart beverage brands Vitamin Water and Red Bull. Their aim is not to build a technology that the entire world will use, but a finely honed youth brand. "Our backgrounds--we're about brands. The site is as much a brand as it is a product, and we spent so much time trying to do that," Rosenberg says. "We're only focused on 13- to 30-year-olds that are socially active. We're a social tool." Idea emerges And the company almost didn't happen in the first place. Shortly after they'd thrown in the towel on eDopter, Rosenberg and Thompson went to a concert by electronic rockers Bloc Party and spent some time talking about how difficult it was to connect with friends at the crowded event. They envisioned some kind of mobile software that could bring it all together. But they were skeptical: "I was kind of looking for a job. We weren't sure we wanted to go down this path again," Rosenberg admits. It was another fortuitous set of school connections that made things happen, Rosenberg and Thompson relate. Jeff Rosenthal, a friend of Rosenberg's from college, had recently begun working for the Summit Series, an elite annual gathering of young entrepreneurs, and the two were hanging out with Doug Imbruce, a New Yorker on the verge of moving to the Bay Area to start a now-buzzworthy and well-funded endeavor called Qwiki. It was a clear summer day, Rosenberg recalls, and they were hanging out by New York's downtown waterfront at North Cove Marina, a small set of moorings off the Hudson River that are packed to the seams with sailing schools' vessels, a few small private yachts, and upscale floating bars that host many a Financial District company's booze cruise. Rosenberg was struck by Imbruce's confidence. "No one knew what Qwiki was, no one had even heard of him, and he's like, 'I had this idea for this thing. I'm raising money for it'," he relates. "And I was like, yeah, I told him about what we were doing, that I'm thinking about getting a job, I don't know what to do, I have this one idea but I'm not sure it's any good. I told him the idea for Fast Society and he's like 'Dude. You gotta do that.'" Seduced by the same entrepreneurial siren song, Rosenberg and Thompson decided to go ahead with Fast Society. They called up Constantiner, then living in Los Angeles and working at talent agency CAA, to convince him to join them. "I'd wanted to do a start-up of my own, or something, so Matthew called me, and we'd been talking, and he was like, 'Look, we have this idea to do this group text-messaging app, and we'd love to have you help out," Constantiner relates. "I was driving to work that morning, and I just end up circling the building, making loops around CAA at 8:30 in the morning while we were on the phone for like, 30 minutes. And I went in and basically told my boss that day that I was leaving." 'Built to party' Assembling a team is one thing. Building and releasing a product is another. Making it through SXSWi as a brand-new start-up is Herculean. Fast Society has tried to cover all the bases: They've booked a party venue in a strategically close location to the central goings-on at the Austin Convention Center. They've enlisted an event planner, Ben Hindman, a former marketer for men's entertainment brand Thrillist who's in a similar make-it-or-break-it position as he gets closer to the launch of his own company, One Clipboard. They're doing everything they can--up to and including appeals to divine intervention--to ensure that the overhauled app shows up on the iTunes Store in time. But just being ready isn't enough. SXSWi is less a technology conference than an annual experiment in hypercharged socialization, a driving range for whacking mass amounts of digital media at the proverbial wall and attempting to see what sticks, a test of the human limits of social app overload. There will, invariably, be at least a dozen other parties that night, some heavily promoted over the weeks leading up to the festival, and some planned and announced a matter of hours before they flood the Driskill Hotel bar with badge-wearing conference goers. The outdoor-terrace-laden Austin could be hit by a rare deluge of rain, as it was during one night of SXSWi last year. It's exactly the kind of noise and chaos that Fast Society and its competitors are designed to help people navigate, but these new companies have to prove their ability to navigate it, too. Failing the first time around may not have given Rosenberg and his co-founders the track record of GroupMe, whose co-founders left plum engineering gigs at Gilt and Tumblr to start their company, or Beluga, with the street cred of an ex-Googler founding team. But it's given them a taste of reality, they say, and it's made them gutsy. "The reason we've been able to do Fast Society, the reason that this feels awesome just to be here, is that it's never been easy for us," Rosenberg says. "We're a company that's never had it easy. Everything we've ever had to do or make has just been a straight-up hustle." They have a believer in Doug Imbruce, the Qwiki founder whose enthusiasm inspired them in the first place. "With a tag line 'built to party,' how can it not succeed at SXSW?" Imbruce wrote to CNET via e-mail. "That's practically the conference's tag line." In the back of the Dogpatch Labs conference room, there's a dry-erase whiteboard--the preferred wall hanging of young, volatile start-up life--as the Fast Society co-founders are still bouncing around potential ideas for SXSWi. As long as they can afford it, nothing's out of the question. The only thing that's for sure, Rosenberg says: "We want to do something that's f***ing cool."


Sprint Nextel Was The Second Leading Carrier In The Northeast

Sprint Nextel was the second leading carrier in the Northeast but didn't fare as well throughout the rest of the country. And T-Mobile, which is anxiously waiting to get scooped up by AT&T, took the second spot behind Verizon in the Southeast and West but was closer to the bottom in most other regions in the U.S. Compared with other wireless carriers, Verizon has consistently taken the lead in performance, reliability, and customer care in past J.D. Power studies. To gauge the reliability of wireless carriers, J.D. Power looked at a variety of issues, including dropped calls, calls not connected, audio problems, failed or late voice mails, lost calls, text message failures, late text message notifications, Web connection errors; e-mail connection errors, and slow downloads. On average, the survey found that smartphone customers bump into more problems than do owners of traditional cell phones, perhaps proving a type of "Murphy's Law" dictum that the more complex the gadget the more that things can do wrong. Across the top 30 U.S. markets, problems were fewest among customers in the Salt Lake City area and highest among those in Sacramento. J.D. Power based its latest results on feedback from 22,110 wireless customers collected between January and June of 2011.


Earlier This Week Facebook Hosted A Facebook D

Earlier this week, Facebook hosted a "Facebook D.C. Live" event called "Social Media's Role in Disaster Preparedness & Response," in conjunction with the National Weather Service, the Red Cross, and the U.S. Dept. of Health and Human Services. There, officials discussed how Americans are using social tools in disasters and shared results from the aforementioned Red Cross study.(See infographic at end of story.) The live streamed event is archived at Facebook. Looking to 3G Of course, there's a reality check to all this: When the power goes out, so does your computer and your Wi-Fi. During big disasters, cellular networks often get jammed. Data networks, however, are still an option because they can handle more traffic than cellular networks. So, over 3G networks, wireless applications like Facebook, Twitter, and mobile video calling service Tango remain functional. The other caveat about social networks? They're "a crowded communication service," explains Eric Setton, Tango's CTO and co-founder. "You don't know if the people you are trying to reach actually received your messages." Hosni Mubarak Trial Big Test For New Egypt

Former Egyptian President Hosni Mubarak, who is charged with ordering the deaths of hundreds of protesters, has appeared in court for the second time. His trial is a big test for the new Egypt, says BBC Middle East editor Jeremy Bowen in Cairo. As Mr Mubarak, old and ill, was wheeled into the courtroom, a man dressed in a white prison uniform turned away from the stretcher, shook his head in exasperation and put his hand over the lens of the television camera that was relaying the scene live to millions of rapt viewers. The man was Alaa Mubarak, once a prince of the old regime, one of the ex-president's two sons who have been brought down by his father's disgrace. Gamal, his brother, was the heir apparent, the crown prince. Both are charged with corruption alongside the former president, who also faces a capital charge of murder. They spent much of their time in the prisoner's cage in the courtroom trying to shield their father from the cameras. 'Cover-up' The euphoria of the revolution that ousted Mr Mubarak in February faded very fast. Egypt faces a list of problems that will not be solved easily or quickly. But it is still remarkable to see the man who was the absolute ruler of Egypt behind bars in a courtroom in a hospital bed, flanked by sons whose lives of wealth, privilege and power have changed beyond measure. Millions of Arabs - who have found the two sessions so far of the Mubarak trial compulsive viewing - won't, it seems, get the chance to see part three live. When the court reconvenes on 5 September, moving from procedure to substance, according to Judge Ahmed Rifaat, cameras will be banned from the courtroom. It is assumed that Judge Rifaat wants lawyers to stop showing off, though some Egyptians will smell a cover-up. Bad omens The trial is still a solid achievement for Egypt's revolutionaries, a distraction in an unhappy, fretful country. It is also a big test for the new Egypt. Once again the omens were not good, with the judge struggling to bring order to what had become judicial chaos - and outside the courthouse riot police charging opponents of the former president after they clashed with Mubarak supporters. The trial is being held at what used to be called the Mubarak police academy. The police were expecting trouble outside, and so were Mr Mubarak's supporters. His opponents brought their own rocks. "We don't want Mr Mubarak humiliated," one of his supporters said. "That humiliates all Egyptians." His opponents brandished hangman's nooses, demanding his execution. Not long after the ex-president was wheeled into the courtroom cage, the riot started outside. The police waded in, but could not stop men - and even a few women - trading rocks and punches. A lot of hatred was stored up in the Mubarak years. Deep divisions The Mubarak legacy touches every part of Egypt. The way the country deals with it will shape the new system as it emerges. But as the violence outside the trial showed, Egyptians are uncertain and deeply divided about the way this country should go. Judge Rifaat complained about the noise being made by more than 100 lawyers, telling them to sit down and to show some respect. To try to streamline the legal process, he merged the Mubarak trial with that of the former Interior Minister, Habib al-Adly, and six of his former aides. Like the ex-president, they deny ordering the killing of protesters. The judge says witnesses will start to testify when the trial resumes next month. The defence says it will call 1,600 of them.

Update: 4:30 p.m. PT To include statement from BREIN Dutch antipiracy group BREIN says it has found documents tying one of The Pirate Bay founders to the company listed as the owner of the Thepiratebay.org, Reservella. According to a blog post by Peter Sunde Kolmissoppi, one of the founders of the BitTorrent search engine, BREIN has filed a complaint against The Pirate Bay founders, who include Fredrik Neij and Gottfrid Svartholm. The Pirate Bay has been outlawed in the Netherlands. During that hearing, BREIN produced documents, including a credit report, showing that Neij is listed as CEO of Reservella. Kolmissoppi denied that Neij is connected to Reservella, and he said the documents are phony. "We were quite sure (Neij) did not have an offshore company set up," Kolmissoppi said. "And if he did, at least he would be smart enough to not be a director in it." Tim Kuik, BREIN's director did not address Kolmissoppi's allegations that his group forged documents in a statement issued by the group. "Denying their responsibility and playing hide and seek is what the gentlemen of The Pirate Bay have been doing since they began their illegal business", saids Tim Kuik, BREIN's director. "We have sufficient reason to assume that they still are responsible. The company on the Seychelles looks like a thin veil to cover up what is really going on." The Pirate Bay founders maintain that the site is owned by Reservella, a company based in the Republic of Seychelles, off the coast of Africa. This spring the entertainment industry alleged that Reservella is controlled by the founders of The Pirate Bay. This has been an eventful few weeks for The Pirate Bay. It has been hounded across Europe, as copyright owners have chased it from one Internet service provider to the next. The site has gone down for extended periods several times, with the most recent outage occurring on Monday. Even after some fans have given the site up for dead, it comes right back. But there's no denying that film studios, TV networks, book publishers, music labels, and anyone else that objects to the file swapping that The Pirate Bay helps facilitate is ratcheting up the pressure on the three founders. A year-long jail sentence and a $3.6 million judgment is already hanging over their heads. Any ISP that provides bandwidth to The Pirate Bay faces legal challenges. And now the Dutch courts have The Pirate Bay in their crosshairs. Kolmissoppi said he intends to file criminal charges against BREIN and some of its leaders for fraud.

A Company Called Ubertwitter That Operates A Suite Of Third Party

A company called UberTwitter that operates a suite of third-party Twitter applications--and hopes to do much more, with $17.5 million in new funding and the planned acquisition of popular client TweetDeck--has apparently run afoul of Twitter big-time. The microblogging service has suspended its apps, which include mobile clients UberTwitter, Echofon, and Twidroyd, as well as an advertising product, citing a number of violations. "These violations include, but aren't limited to, a privacy issue with private Direct Messages longer than 140 characters, trademark infringement, and changing the content of users' Tweets in order to make money," a statement from Twitter explained. That's some pretty serious stuff. "We've had conversations with UberMedia, the developer of these applications, about policy violations since April 2010, when they first launched under the name TweetUp--a term commonly used by Twitter users and a trademark violation," the statement continued. "We continue to be in contact with UberMedia and hope that they will bring the suspended applications into compliance with our policies soon." The undercurrent here is that UberMedia is also positioning itself as a business threat to Twitter, seeing as it's one of the few owners of powerful Twitter applications that compete with the ones that Twitter itself has begun to offer, and therefore could actually dissuade users from Twitter's official products (and revenue streams). Twitter has earned plenty of developer ire for its release of official products that will likely quash those offered by independent players in its historically vibrant developer community, and its policing of third-party applications that include the word "twit" or "tweet" has had plenty of opponents as well. But if UberMedia's tactics are as shady as Twitter seems to allege they are, that's a problem. UberMedia CEO Bill Gross released a statement later on Friday to say that the apps are coming back: "We were immediately in touch with Twitter, and the changes they asked us to make were very small," he wrote. "As a result, we have completed the changes, and new apps are currently being posted to their respective stores. Twitter has assured us that as soon as those changes were complete, they would reactivate our applications." But one of those changes addresses the trademark infringement that Twitter mentioned: UberTwitter's name. "Twitter also asked us to modify the name of UberTwitter," Gross wrote. "We began a process of changing the name three weeks ago by polling our users, and we've decided based on their input to change the product name to UberSocial, which we completed today." Style-guide gaffe In July, UBS reported a drop in quarterly profit, and last month the company announced 3,500 jobs cuts. It also said its target for pre-tax profit set in 2009 was unlikely to be achieved in the original time frame. In recent years, the bank has been trying to build credibility after being hit hard by the sub-prime crisis. Following huge losses on toxic assets held by its investment bank, it received a $60bn bailout from the Swiss government in 2008. In February 2009, UBS announced that it had lost nearly $17bn in 2008, the biggest single-year loss of any company in Swiss history. That month, Oswald Gruebel, a former Credit Suisse executive, took the helm as chief executive. The company also became embroiled in a serious tax evasion dispute with US authorities and was forced to hand over 300 client names and pay a $780m fine.
